1.1 Introduction These General Terms & Conditions (“Terms”) govern the access to and use of the PoetikAI platform, including its website, applications, and related services (collectively, the “Service”), operated under the name PoetikAI. By accessing, registering for, or using the Service, you (“User”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the PoetikAI platform. For the purposes of these Terms & Conditions, the following definitions shall apply: "PoetikAI" / "Service" / "Platform" Refers to the PoetikAI website, application, and related services that provide automated screenplay and script analysis using artificial intelligence technologies. "User" / "You" Refers to any individual or legal entity who accesses, uses, or interacts with the PoetikAI Platform, whether as a registered or unregistered user. "Script" / "Content" / "User Content" Refers to any screenplay, script, text, or written material uploaded, submitted, or otherwise provided by the User to the Platform for analysis. "Artificial Intelligence" / "AI" Refers to automated computational systems and machine-learning models that analyze textual input based on statistical, structural, linguistic, and narrative patterns. AI systems do not possess human judgment, intent, consciousness, or editorial discretion. "Analysis" / "AI Analysis" Refers to the automated evaluation, breakdown, classification, and interpretation of scripts performed exclusively by AI systems. Analysis includes structural, thematic, narrative, stylistic, and comparative observations generated algorithmically and does not constitute human review, editorial feedback, legal advice, or professional judgment. "Output" / "Analysis Results" Refers to all feedback, scores, classifications, summaries, recommendations, or other analytical materials generated by the Platform as a result of AI Analysis. "Terms" Refers to these General Terms & Conditions, including any updates, amendments, or supplementary policies referenced herein.
PoetikAI is an AI-powered script analysis platform designed to assist writers, filmmakers, and creative professionals by providing automated analytical feedback on uploaded scripts. The Service enables Users to: • Upload scripts for automated analysis; • Receive AI-generated evaluations related to structure, narrative elements, characters, themes, pacing, tone, and other screenplay-related aspects; • Access analytical insights intended to support creative development and self-evaluation. PoetikAI operates exclusively through automated processes. No human reading, editorial selection, manual review, or subjective judgment is involved in the analysis unless explicitly stated otherwise. The Service is provided for informational and creative support purposes only. PoetikAI does not guarantee accuracy, completeness, commercial viability, originality, legal compliance, or suitability of any script for production, publication, or distribution. Users acknowledge that AI-generated analysis reflects probabilistic assessments based on patterns and models, not definitive evaluations or professional opinions.
4.1. Account Creation To access certain features of the Service, Users may be required to create an account. Account registration requires the provision of accurate, current, and complete information as requested during the sign-up process. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. 4.2. Eligibility The Service is intended for individuals who are at least 18 years of age. By creating an account or using the Service, the User represents and warrants that they are legally capable of entering into a binding agreement and, where applicable, authorized to make payments through the platform. 4.3. Accuracy of Information Users agree to provide truthful and accurate information during registration and to keep such information up to date. PoetikAI reserves the right to suspend or terminate accounts where false, misleading, or incomplete information has been provided. 4.4. Account Responsibility Users are solely responsible for all activities conducted through their account, including the uploading of scripts and the use of analysis results. PoetikAI shall not be liable for any loss or damage arising from unauthorized access to a User’s account resulting from the User’s failure to safeguard login credentials. 4.5. Account Suspension or Termination by PoetikAI PoetikAI reserves the right to suspend or terminate a User’s account, with or without notice, if the User: • Violates these Terms & Conditions; • Uses the Service in an unlawful or abusive manner; • Attempts to interfere with the technical operation of the platform; • Submits content that is clearly illegal or infringes third-party rights. 4.6. Account Deletion by the User Users may request the deletion of their account at any time through the account settings or by contacting PoetikAI via the provided contact channels. Upon account deletion, access to the Service will be terminated. Analysis reports may be removed in accordance with the platform’s data retention policies.
5.1. Lawful Use Users agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. 5.2. Acceptable Use Users agree not to: • Upload or submit content that is illegal, unlawful, or promotes criminal activity; • Infringe upon intellectual property rights, privacy rights, or other rights of third parties; • Upload content that is defamatory, abusive, hateful, or intentionally harmful; • Use the Service for harassment, impersonation, or deceptive practices; • Attempt to reverse engineer, copy, scrape, or exploit the platform or its underlying technology; • Interfere with or disrupt the security, performance, or functionality of the Service. 5.3. Prohibited Technical Use Users must not: • Attempt to bypass usage limits, paywalls, or access restrictions; • Use automated tools, bots, or scripts to access or interact with the Service without authorization; • Introduce malware, viruses, or other harmful code into the platform. 5.4. Responsibility for Uploaded Content Users remain solely responsible for any scripts, text, or other materials they upload. PoetikAI does not verify, monitor, or moderate user-submitted content and assumes no responsibility for its legality, originality, or accuracy. 5.5. Use of Analysis Results Analysis outputs provided by PoetikAI are intended for informational and creative development purposes only. Users agree not to represent AI-generated analysis as professional, legal, editorial, or financial advice, nor to attribute such analysis to PoetikAI in a misleading or defamatory manner. 5.6. Fair Use and Platform Integrity Users agree to use the Service in good faith and in a manner consistent with its intended purpose. Excessive, abusive, or manipulative usage that threatens platform stability or fairness may result in temporary suspension or permanent termination of access. 5.7. Consequences of Violations PoetikAI reserves the right, at its sole discretion, to suspend, restrict, or terminate access to the Service if a User violates these Terms or engages in conduct that harms the platform, other users, or PoetikAI’s legitimate interests.
6.1. Platform Ownership All intellectual property rights related to the PoetikAI platform, including but not limited to software, algorithms, AI models, design elements, user interface, logos, trademarks, text, graphics, and documentation, are owned by or licensed to PoetikAI. These materials are protected by applicable intellectual property laws. 6.2. User Content Ownership Users retain full ownership of any scripts, screenplays, texts, or other materials they upload to the Service. PoetikAI does not claim ownership, authorship, or copyright over User Content. 6.3. Limited License for Processing By using the Service, Users grant PoetikAI a limited, non-exclusive, non-transferable, and revocable license to process User Content solely for the purpose of performing automated analysis and generating analysis outputs for the User. 6.4. Analysis Outputs Analysis reports and analytical outputs generated by PoetikAI are the result of automated processes and constitute proprietary platform output. Users are granted a limited, non-exclusive license to access, download, and use such outputs for personal, educational, or professional development purposes. 6.5. No Rights to Derivative Works PoetikAI does not claim any rights in derivative works, revisions, or subsequent versions of User Content created by the User, regardless of whether such works are informed by or influenced by the analysis results. 6.6. Trademarks and Branding The name “PoetikAI,” its logo, and all related branding elements are trademarks or trade dress of PoetikAI. Users may not use these marks without prior written permission, except as necessary to reference the Service in a factual and non-misleading manner. 6.7. Feedback and Suggestions If Users voluntarily provide feedback, suggestions, or improvement ideas regarding the Service, PoetikAI may use such feedback without obligation or compensation, provided that such use does not claim ownership over User Content or creative works.
7.1. General Principles PoetikAI respects user privacy and is committed to protecting personal data in accordance with applicable data protection laws and generally accepted data protection principles, including lawfulness, transparency, purpose limitation, data minimization, and security. 7.2. Personal Data Processing PoetikAI processes personal data only to the extent necessary to provide and operate the Service, including account creation, authentication, billing, customer support, and delivery of analysis results. Personal data may include, but is not limited to, name, email address, account credentials, payment-related information, and usage data. 7.3. Script and Content Data Scripts and uploaded content are processed solely for the purpose of performing automated analysis and generating analysis outputs for the User. PoetikAI does not use User Content for marketing, resale, or independent training purposes. Scripts are not reviewed by humans as part of normal Service operation. 7.4. AI Infrastructure and Data Transfers To deliver the Service, PoetikAI may rely on third-party technical and AI infrastructure providers. During automated processing, User data and content may be transmitted to such providers strictly for service execution. PoetikAI does not authorize third parties to use User data for their own purposes beyond providing the agreed technical services. 7.5. Data Retention Personal data is retained only for as long as necessary to fulfill the purposes described in these Terms or as required by applicable law. Analysis reports may remain accessible within the User account until deleted by the User or account termination. 7.6. Security Measures PoetikAI implements reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or misuse. However, Users acknowledge that no system can guarantee absolute security. 7.7. Privacy Policy This section provides a summary of PoetikAI’s data protection practices. 8.1. Service Provided “As-Is” PoetikAI and its services are provided on an “as-is” and “as-available” basis. No warranties are made regarding the accuracy, completeness, reliability, or suitability of the platform, analyses, or any associated content. 8.2. No Professional Advice All insights, analyses, and outputs generated by PoetikAI are for informational and supportive purposes only. They do not constitute professional, legal, financial, or production advice. Users are responsible for any decisions or actions taken based on the service. 8.3. User Responsibility Users acknowledge that any creative, commercial, or professional decisions made using PoetikAI services are solely their responsibility. PoetikAI is not liable for outcomes related to development, production, financing, distribution, or reception of any project. 8.4. Limitation of Liability To the fullest extent permitted by law, PoetikAI shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, loss of data, or other financial losses arising from the use of the platform. 8.5. Third-Party Services and Infrastructure PoetikAI may rely on third-party AI infrastructure or service providers to process scripts. PoetikAI is not responsible for any errors, delays, or data handling issues caused by such third-party services. 8.6. No Guarantee of Results While PoetikAI applies technical and organizational safeguards, the platform does not guarantee any specific outcome, result, or benefit from the use of its services. Users acknowledge and accept the inherent limitations of automated analysis.
9.1. Service Fees and Credits Certain features of PoetikAI may require the use of credits or payment. Users agree to pay all applicable fees for services, credits, or subscriptions according to the pricing listed on the platform. 9.2. Payment Methods Payments must be made using the payment methods supported by PoetikAI. Users are responsible for providing accurate and complete billing information. 9.3. Refunds and Cancellations All purchases are non-refundable, unless otherwise stated explicitly in the platform’s refund policy. Users may cancel subscriptions or credit packages at any time, but no retroactive refunds will be issued for unused credits or time. 9.4. Account Responsibility Users are responsible for any charges incurred through their account. PoetikAI is not liable for unauthorized use of accounts or payment methods if caused by negligence or failure to secure account credentials. 9.5. 10.1 Service Availability PoetikAI aims to provide continuous access to its platform; however, the Service may be temporarily unavailable due to maintenance, technical issues, or other unforeseen circumstances. 10.2 Modifications PoetikAI reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. 10.3 No Liability for Service Interruptions Users acknowledge that temporary disruptions or changes to the Service are normal operational risks. PoetikAI shall not be held liable for any loss, inconvenience, or damage resulting from service interruptions or modifications.
11.1. By the User Users may terminate their account at any time by following the account deletion process. Termination by the User does not exempt them from obligations incurred prior to termination. 11.2. By PoetikAI PoetikAI reserves the right to suspend or terminate User accounts at its sole discretion, including for violation of these Terms, illegal use, or conduct deemed harmful to the platform. 11.3. Effect of Termination Upon termination, User access will be revoked. PoetikAI may retain certain information as required by law or for legitimate business purposes.
These Terms & Conditions shall be governed by and construed in accordance with the laws of Germany. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in Germany.
